1) Acceptance & Use
These Terms form a binding agreement between you and Forever Homestead (“we,” “us,” “our”). You may use the site only in compliance with these Terms and all applicable laws.
2) Eligibility & Accounts
Minimum age: You must be at least 18 (or the age of majority in your jurisdiction) to place orders.
Account info: Keep your login credentials confidential and your information accurate. You’re responsible for activities under your account.
We may suspend or terminate accounts that violate these Terms or applicable laws.
3) Orders, Payments & Taxes
Payment authorization: By submitting an order, you authorize us (and our payment processor) to charge your selected method for the full amount, including taxes, shipping, and any fees.
Sales tax & fees: Applicable taxes are calculated based on your shipping/pickup address and added at checkout.
Processing fees: Third-party processing fees are generally non-refundable unless the return is due to our error.
Order acceptance: We may refuse or cancel any order, including due to availability, errors, or suspected fraud. If we cancel after charging you, we’ll issue a refund.
4) Products, Availability & Pricing
Handmade variance: Small variations in color, grain, scent, weight, or finish are normal with handmade goods and are not defects.
Information: We try to be accurate, but typographical, pricing, or availability errors may occur. We reserve the right to correct errors without notice.
Custom woodworking: Custom items become final sale once materials are purchased or production begins. We’ll confirm proofs/measurements before starting.
5) Shipping, Pickup & Risk
Risk of loss: Transfers to you upon delivery to the shipping carrier or at local pickup.
Inspection window: For perishables, report issues within 24 hours of pickup/delivery with photos.
Delays: We aren’t liable for delays outside our control (carrier, weather, supply constraints).
Candles & Soaps (non-custom): Unused, unopened items returnable within 14 days in original packaging.
Custom Woodworking:Final sale once production begins; eligible for repair/replacement if damaged/defective on arrival.
Perishables (Eggs & Whole Chickens):All sales final for food safety; report issues within 24 hours.
Sale/Clearance: Final sale unless defective on arrival.
7) Pig Share Program
Deposits:Non-refundable. Deposits secure livestock and processor time and cannot be returned.
After scheduling: Any additional payments made after your processing/harvest date is scheduled are non-refundable.
Transfers: You may transfer your share to another customer; email us to coordinate.
Processor policies: You’re responsible for timely pickup and any cut/wrap/storage fees per the processor.
8) Intellectual Property
All content on the site—text, logos, product photography, videos, graphics, and code—is owned by Forever Homestead or our licensors and is protected by IP laws. You may not copy, modify, distribute, or use our content without written permission.
9) User Content & Reviews
You’re responsible for content you submit (reviews, comments, photos). Do not submit unlawful, misleading, infringing, or harmful material.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your submitted content for site operations and marketing (e.g., showcasing reviews), subject to our Privacy Policy.
We may remove content at our discretion.
10) Prohibited Conduct
Violating laws or third-party rights.
Interfering with the site’s security or operation, scraping, or reverse engineering.
Submitting false orders, chargeback abuse, fraud, or misleading information.
Posting spam, malware, or content that is obscene, harassing, or hateful.
11) Disclaimers
Except as expressly stated, our site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
12) Limitation of Liability
To the maximum extent permitted by law, Forever Homestead and our owners, employees, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the site or products. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.
13) Indemnification
You agree to defend, indemnify, and hold harmless Forever Homestead and our owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the site or products.
14) Privacy
Your use of the site is also governed by our Privacy Policy, which explains what data we collect and how we use it.
15) Changes to the Terms
We may update these Terms from time to time. When we post changes, we’ll update the “Effective” date above. Continued use after changes means you accept the revised Terms.
16) Governing Law & Dispute Resolution (Virginia)
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules.
You agree to the exclusive jurisdiction and venue of the state and federal courts located in [Your County], Virginia (and the U.S. District Court for the [Eastern/Western] District of Virginia, as applicable). You waive any objection to such courts on the grounds of venue, forum non conveniens, or lack of personal jurisdiction.
Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
17) Miscellaneous
Severability: If any provision is unenforceable, the remainder remains in effect.
No waiver: Our failure to enforce a provision isn’t a waiver.
Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
Entire agreement: These Terms and the policies linked here (e.g., Refunds & Returns, Privacy) form the entire agreement between you and us regarding the site and products.
